Amidst speculation from all corners over how Vijay Mallya was allowed to leave India despite CBI look-out notice, a new piece of information confirms that CBI actually downgraded the nature of their notice which allowed Vijay Mallya free travel. The information comes as embarrassment to CBI and they are under flak for being too soft on Mr. Mallya.
According to sources, on 16th October, 2015, a CBI look-out notice stated that if Vijay Mallya attempts to leave the country, he is to be detained. In November, the look-out notice was changed to only inform CBI whenever he left the country and no action was to be taken. Mr. Mallya traveled outside India in October and returned in November. He made two more trips in December. Every time CBI was informed of his travels.
According to CBI, the look-out notice was downgraded as Vijay Mallya was cooperating fully with the agency and appeared for questioning whenever asked. The source further clarifies that passport can only be impounded if charge-sheet has been produced or the person is under trial. As Vijay Mallya always came back to India from his trips, CBI did not feel the need to stop his movements.
